Copy. Bernard to Uniacke. In receipt of letter. Is still of opinion that they should not be importunate in pressing Nova Scotia's needs while war is occupying ministerial attention. Accepts Assembly's vote as retaining his services. N. Bond is appointed to vice-presidency of Committee of Trade in Lord Glenhervie's place.

Copy. Speaker (Uniacke) to Agent (Bernard). In receipt of letter with enclosure. Hopes he will accept Assembly's vote as retainer of his services. Disastrous effect of the war on the fisheries. Peculiar situation of N.S. gives her needs different to those answered by the general colonial system. Unless modifications are made Americans will become sole owners of North Atlantic fishery. U.S. supplies West Indies with N.Scotian fish, which Americans pay for in their own and foreign produce, which is against Navigation Laws; but "surely when Great Britain by treaty laid every harbour in N.S. open to foreign Vessels it was but reasonable for the inhabitants to Expect that some regulations would be made in their favour, so as at least to put their trade on a footing with the foreign trade admitted into their ports yet notwithstanding the immense change of Circumstances we are at this hour left to struggle under the restraints and prohibitions of the old system by which means our people are daily becoming more and more habituated to the violation of laws which are considered to injudicious and improvident that no person gives any aid to their Execution save those who official Situations make them responsible and who unassisted as they are can effect little or Nothing. Copy. S. Bernard to the Speaker. Has sent copy of his (Uniacke's) last letter, explaining desires of N.S. government, to Lord Glenhervie (vice-pres. of Committee of Trade). Encloses copy of Glenhervie's answer. The war interferes with any action Govt. might otherwise take towards revising colonial system. If he continues to do nothing to earn it, Bernard will not accept salary as Agent. Enclosure: Copy of Lord Glenhervie's letter to Bernard, approving but postponing consideration of Uniacke's suggestions.

Speech of Lieutenant Governor Wentworth on closing the session without the Appropriation Bill having been passed. He will proceed as was the practice before Appropriation Bills were regularly passed in the province. Signed.

Message of the Lieutenant Governor to the Assembly, in answer to their address on 5th July, stating that, in his recommendation of 4th July, he "had no intention to obstruct the application of any sum within the ability of the province to so important and beneficial a measure, or to deprive the Assembly of its Constitutional Right of inquiring into the Conduct of all Public Accountants, or directing the Prosecution of Delinquents in the expenditure of Public money. His object was "merely to reserve to the Executive Government the General Superintendence and direction of all appropriations of Monies granted to the Crown for public Service, and the Control of such Persons as should be appointed to expend the same, and These Powers being Prerogative Rights, although they may have been in some instances left to the Management of the Assembly, may be constitutionally resumed by His Majesty's Representative, whenever he thinks the general Interest requires it."

Message of Lieutenant Governor to Assembly, stating that experience has convinced him that "the mode which has been adopted for several years past relative to the distribution of the monies granted for the making and repairing of Roads and Bridges, as well as for the payment of the different sums and the accounting of the Commissioners, is liable to very serious objections", and recommending that the House grant a sum "to be laid out by commissioners named and appointed by the Lieutenant-Governor, and pursuant to such particular Instructions as they may respectively receive from him and accountable, as the Law require to the executive Government only". Further recommendations of sums for completing Govt. House, for a clerk for Treasurer's office, for repair of school house, for Sable Island establishment, and for annual repairing of firearms issued to militia. Signed.
