Sir Rupert
I herewith transmit for the consideration
of his Excellency the Lieut. Governor a statement
of the improvements made by the Indians
on certain land in the Settlement of Pomquet
together with the Affidavit of Dominique
Philyspar one of the oldest and most respectable
settlers in the immediate neighbourhood of the
Land Some of the Indians attended here yesterday
but It was judged unnecessary to take their
depositions but the following are the facts
to which they will swear That they settled
on the land granted to McWhinnie nearly three
years ago and improved two acres and a half that
they removed from them twenty [five OR four?] years ago and
settled twenty three years ago on the lands granted
to Colin Campbell and H. H. Cogswell that
eighteen years ago they were ordered by some persons
who cut the hay on some Marshland on the
farm of Campbell' lot to remove from it and
they did so at that time and have ever since
confined themselves to Cogswells lot till two
years ago when they moved again to McWhinnies
[?Elisha Randal] Senr. [senior] of Little River and Adolphus
Atwater of Pomquet who have resided twenty
seven years in the neighbourhood of the land
have offered to make affidavit to nearly the same
things if necessary of trust however that his
Excellency will be satisfied with what has been
done and that It will not be thought necessary
to put these men to any more trouble on this
account
