Preliminary examination into the manslaughter charges resumed. Evidence directed mainly to the case of Commander Wyatt. Mr McInnes, K. C., contended on behalf of Commander Wyatt that there was nothing to warrant committal for trial. Commander Wyatt did not know the morning of December 6th that the "IMO" was going out. Crown Prosecutor Cluney said that the duties of Commander Wyatt were to regulate ships in the harbor, etc., and that it was his office that was advised from the guardship at the mouth of the harbor of the arrival of ships. Notification was given of the "MONT BANC" and her cargo of high explosives, but she was allowed to enter without any more precautions than for a cargo of potatoes.
Mr. McInnes also argued on behalf of Capt. Lemedec, of the "MONT BLANC" and Mr. O'Hearn, K. C., put up a like argument for Pilot Mackey.
Stipendiary McLeod announced that he would commit Capt. Lemedec and Pilot Mackey for trial and would put Commander Wyatt on trial and bind him over for appearance at the Supreme Court criminal trial sittongs. Bail for Commander Wyatt was fixed at $6000. Capt. Lemedec's bail was fixed at $10,000. Pilot Mackey's bail was fixed at $6000.
