Petition to Kempt: Petitioner is a native of Edinborough, age 37, married, and has three children. He has for many years been settled on a 400 acres farm at the River Inhabitants, for which his father held a crown lease and for which petitioner now asks a grant. The father, Alexander McPherson, died nine years ago and left this lot to the sons, petitioner and his brother David, also 230 acres which had been purchased to the widow, Elizabeth McPherson. A third brother, Alexander, had been provided with land before the father's death, his sisters are also married and settled. David exchanged his share of the land willed him for the mother's lot with the brother Adam, to become his property after the mother's death. The mother has lived with him until the preceding fall when she went to live with David at the Gut of Canso, and petitioner fears that David may, under this circumstance recede from the original bargain. Petitioner objected to taking any oath from fear of obligations any oath would impose on him. Note: the two brothers may have a grant in common according to the father's will.
