I am of opinion the seamen in the case you have submitted should be paid out of the saving from the ship and rigging and that their wages should not be made to depend upon whether freight had been earned as the ship is in the first place liable otherwise

Should there not be sufficient of materials and rigging [illegible] I think they should be paid out of the property saved otherwise they may claim for salvage under the circumstances of this case
