might appoint, and in your letter you inform him you have concluded the investigation " without having examined one of the Parties who made the charges to him. I am bound to say that this in my opinion is a mode of enquiry not adapted to discover the truth, and to show [illegible] Mr Binney's disapprobation of it, and to make it matter of record in the proper quarter, a copy of this letter has been transmitted to His Excellency through the Secretary's Office. You have now suffered several of the principal Witnesses to leave the Province after due notice of their intention, X and as I am informed in opposition to His Excellency's express commands, X without being examined; and it does appear to me that this neglect upon your part, has left grounds of suspicion against Captain Darby, which no enquiry conducted hereafter can efficiently remove — I intend to convey nothing personally offensive by this language — but I am bound in protecting the interest of my client to express these opinions at the first possible time. Should he ever be involved in a suit, these facts in vindication of his honor must be submitted to the judgment of a Jury.
As to Mr Binney's right to claim a part of the property saved from the Brig Lancaster, he holds a letter from Messrs George McBride Jr + Co giving him full authority to act as their agent in this behalf, and if you will appoint a time and place, I am prepared
