my communications _______ but Your Excellency from the statements made in the accompanying Affidavit which can be corroborated by others, and specimens of the Goods produced, will perceive that I have been well justified in the course I have adopted, and that, so far as I am concerned, I need not fear the result of an action. It is not pecuniary but higher considerations, which induce me to retreat from it if such can be done with honor.

I feel obliged for Your Excellency kind and frank interference in my former application relative to the materials and regret it was not communicated to the Commissioners, or, if so that it was not acted upon _____ for had they done so, they could have been saved from the legal controversy in which on behalf of the owners must now involve them.

I shall be happy to receive any further instructions in this matter, and to follow up your Excellency's wishes.

I have the honor to be
Your Excellency's
very obedient servant
[signature] Stephen Binney
