expense except Provisions and Cooking which they are to provide for themselves as above mentioned And lastly it is mutually agreed between the said parties hereto that either of them neglecting to perform this agreement on his or their part according to the true intent and meaning thereof shall pay to the other of them Fifty Pounds Currency not as a Penalty but as a fixed stipulated and measured damage and compensation agreed to be paid as a debt and to be recoverable or allowed without any relief at Law or in Equity. In Witness whereof the parties to these presents have hereto their Hands and Seals Subscribed and Set the day and year first above written.
