It is hereby agreed between Edward Wallace Edward Cunard + William Lawson Junior Commissioners for Sable Island, of the one part, and Henry S. Jost part owner and agent for remaining owners of the Schooner Sylph of 91 1/2 Tons or thereabouts of the other part, as follows ~ That the said Schooner being tight, staunch + strong and every way fitted for the voyage, shall be let unto the said Commissioners for the term of Five months, certain or longer if required (less eleven days already expired in performance of Trip to Cape Breton + Sable Island) for the protection of the Fisheries and prevention of Smuggling on the coast of this Province, at the rate of Ninety pounds currency per month commencing from the day of the date hereof, the Owners to find all things necessary for sailing and outfit of said Vessel and to furnish a Pilot and Ten able bodied Seamen who are to be victualled and paid by them, and to furnish the Cabin with all necessary and proper provisions &c for the Seizing Officer.

The Seizing Office to have the entire command of said Schooner + Crew, and it is understood that the disposal of her is to be under his control only during said term.

Should any of the Crew desert or be incapacitated by sickness or otherwise during said term, they are at once [^to be] replaced if considered necessary by the Office in command and their Wages to be paid by the Owners.

The Vessel to be at all times properly equipped and provided with the materials necessary for the service in which she is engaged, and if disabled and unable to perform the service for which she is chartered, the hire of said Schooner to cease while so disabled and undergoing any repairs which may be considered necessary.
