testimony in the event of any recourse to law
being necessary Petitioner had the Depositions
of his crew and those who witnessed the
collision taken before a surrogate of the
Admiralty Court but has not sues forth any
[monition] as he hoped that on the report of
Captain Darby that some adjustment would
be made to his satisfaction, such has not
been done and Petitioner has no redress
excepting by application to Your Excellency
or instituting proceedings at law, that the latter
will be ruinous to your Petitioner in
as much as the trades people who repaired
his vessel are urging payment and the
large amount he has already disbursed
leaves him totally without means to [depray?]
the expense of litigation and if successful
the delay will be most prejudicial
Your Petitioner therefore humbly prays
that Your Excellency will direct
inquiry to be made into the truth of
his statements and cause such
Emuneration for his loses to be
made as to Your Excellency shall seem
