watch also hailed and made a similar
request but received no answer that
notwithstanding exertion was made by
Petitioner to escape the said Schooner ran
into your Petitioners vessel carried away the
main-mast and did great damage the main-sail
being full the Daring cuffed up and
came broadside to Petitioner vessel and
passed by.
That Your Excellency's Petitioner apprehensive
that his vessel would sink and finding her
unmanageable called earnestly for assistance
and begged the said Joseph W E Darby to
take him in tow but the only answer th
received was that Jedore was ten miles off
and the said Daring pursued her course
leaving Your Petitioner and his crew to their
fate. That they cleared away the wreck
which occupied them till morning and by
shortening said and working at the pumps
succeeded in reaching Halifax.
That Petitioner has been most materially
injured by the delay of repairing
as well as losing freight and has actually
expended and made himself
liable for Sixty Eight Pounds nine Shillings
That in order to preserve his
testimony
