the County of Richmond and Isalnd of Cape

That Petitioner is owner of a certain Schooner
called the Sarah Livingston that on the eighteenth
day of June cast with cargo of flour he was standing
into Halifax harbour the wind was blowing west south
west and Petitioner was a course close to the wind the
night was clear and the Government Schooner
Daring Captain Joseph W.E Darby was
approaching from the windward [illegible]
free and appeared to be steering directly
down upon Petitioners vessel that he hailed
the said Schooner and called to them to
keep their cuff but received no answer the watch
